Important: Please read these Official Rules before entering this Contest (the “Contest”).
By participating in this Contest, you agree to be bound by these Official Rules and represent that you satisfy all of the eligibility requirements below.

  1. Eligibility: The Contest is open only to individuals who are legal residents of the 50 United States, District of Columbia, or the provinces and territories of Canada (excluding Quebec) and are at least 13 years old at the time of entry. Directors, officers, members, managers, and employees of How To Cake It (“Sponsor”), Instagram, Inc., Big Monocle (“Administrator”), and any of their respective parent companies, affiliate companies, subsidiaries, agents, professional advisors, advertising, promotional, public relations, and fulfillment agencies, consultants, legal counsel, website providers, web masters, and immediate family members (spouses, parent, child, sibling, grandparent, and “step” child, wherever they may live) of each are not eligible to win any prize. a. Go to http://bit.ly/HowToCakeItContest and complete the steps to recognize your Weird or Wonderful friends and enter the Weird and Wonderful contest (enter by (i) clicking on “recognize a friend;” (ii) filling out the entry form as instructed and agreeing to Official Rules; (iii) sending message and special link to the friend; and (iv) having the friend click on the link and agree to the Official Rules. Upon completion of the above steps, you will receive one entry into the Contest. By entering into the Weird and Wonderful Contest (your “Submission”) and posting as instructed above to Instagram (“Entry”), you agree that your Submission and Entry conform to the Guidelines and Restrictions detailed below. Sponsor or administrator may choose to remove any Submission or disqualify you from the Contest if it believes that your Submission OR Entry fails to conform with the Guidelines and Restrictions.

Limit: SEVEN TOTAL ENTRIES DURING THE CONTEST PERIOD. EACH CONTEST PARTICIPANT MAY ONLY TAG EACH RECOGNIZED FRIEND ONCE (SEVEN SEPARATE FRIENDS MAY BE RECOGNIZED AND SUBSEQUENTLY TAGGED). Any attempts to obtain additional entries through fraud or other illegitimate means, such as (1) through multiple or duplicate accounts, names, or links; (2) impersonating other individuals (e.g., the friend you recognize); or (3) bulk or automated entries (including, for example, entries made using any script, macro, bot, or promotional service); or (4) otherwise manipulating the number of entries you receive in an unfair or deceptive way will result in disqualification, at Sponsor’s or Administrator’s discretion. SPAMMING INDIVIDUALS IN YOUR CONTACT LISTS (E.G., THROUGH REPEATED OR DUPLICATE MESSAGES) TO PARTICIPATE AS A FRIEND YOU ARE RECOGNIZING IS STRICTLY PROHIBITED AND MAY RESULT IN DISQUALIFICATION AT SPONSOR’S OR ADMINISTRATOR’S DISCRETION. For the avoidance of doubt, you may speak with your friend and request they participate, but you may not harass, pay, or otherwise coerce individuals into participation into the Contest. Multiple participants are not permitted to share the same Instagram account.

Submission and Entry Guidelines and Restrictions

a. Your Submission and Entry must satisfy the terms and conditions set forth in the Weird & Wonderful Awards Official Rules https://www.1in7billion.com/TrueKeyWeirdAndWonderful/contest-details/.

b. Your Submission and Entry must not supply untruthful, incomplete, inaccurate or misleading information.

c. Your Submission and Entry must be your original creation and be owned 100% by you, or, alternatively, you must have the full rights to grant the license and other rights that you grant to Sponsor in Section 11 below.

d. Your Submission and Entry must not (in Sponsor’s or Administrator’s discretion): (i) contain disparaging or defamatory statements; (ii) include threats to any person, place, business, or group; (iii) be obscene, offensive, or indecent; (iv) depict any risky behavior; (v) contain material that promotes bigotry, racism, hatred or harm, against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; and/or (vi) contain unauthorized third-party trademarks or logos.

e. You warrant and represent that: (i) the use of the Submission and Entry will not violate any third-party rights, including, but not limited to, copyrights, moral rights, trademark rights, or rights of privacy and publicity; (ii) the Submission and Entry do not violate any applicable law, rule or regulation; (iii) to the extent the Submission or Entry depicts any individual or features the voice of any individual, you are the individual pictured and heard in the Submission, or, alternatively, that you have obtained written permission from each person appearing in the Submission or Entry to grant the rights to Sponsor described in these Official Rules, and will make written copies of such permissions available to Sponsor or Administrator upon request; (iv) the Submission and Entry comply with the Instagram terms of use; and (v) the Submission complies with all requirements of these Official Rules.
All content provided in Submissions will be moderated by Sponsor OR ADMINISTRATOR. Sponsor OR ADMINISTRATOR may reject Submissions or disqualify participants at its discretion for failure to comply WITH these Guidelines and Restrictions. If participating in this Contest via your mobile device (which service may only be available via select devices and participating wireless carriers and is not required to enter), you may be charged for standard data use from your mobile device according to the terms in your wireless service provider’s data plan. Normal airtime and carrier charges and other charges may apply to data use and will be billed on your wireless device bill or deducted from your pre-paid balance. Wireless carrier rates vary, so you should contact your wireless carrier for information on your specific data plan.

  1. Identity of Entrant: All Submissions must be submitted by the individual entrant recognizing a friend. In the event of a dispute about the identity of the entrant, entries will be declared made by the authorized account holder of the email address associated with the account on which the Submission is made. An “authorized account holder” means the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The winner may be required to provide Sponsor or Administrator with proof that the potential winner is the authorized account holder of the email account associated with the winning entry.

  2. Selection and Notification of Winner: The Prize winner will be determined according to the following process.
    Grand Prize: On or about April 5, 2017, Yolanda Gampp and a panel of judges selected by her at her discretion will score each of the qualifying Submissions* based on the following criteria:
    1) creativity of the Submission (50%);
    2) originality of the Submission (50%).
    *For the sake of clarity, the Instagram post will not receive a score and only your Submission (the materials provided in entry to the Weird and Wonderful Contest; step 1 of the entry process above) will be scored.

The entrant with the highest scoring Submissions based on the above judging criteria will be deemed the potential winner. The decision of the judge(s) is final. In the unlikely event of a tie, the winners will be determined by the Submission’s score in the following criteria: creativity of the Submission. Odds of winning a prize depend on number and quality of eligible entries received.
Notification of Winner: The potential Grand Prize winner will be notified via email on or about April 30, 2017. If the prize is won by a Minor, that prize will be awarded in the name of the winner's parent/legal guardian on behalf of the winner. To the fullest extent permitted by applicable law, Sponsor may require each individual to sign (and have his/her parent or legal guardian sign if a Minor in his or her place residency) and return, within five days of being notified, an Affidavit of Eligibility and Liability/Publicity Release in order to claim his/her prize. If (i) the attempted notification is returned as undeliverable without a forwarding address; (ii) any required documents are not returned within five days, such as the Affidavit of Eligibility and Liability/Publicity Release or tax forms; or (iii) if potential winner is otherwise unable to accept the prize as stated, the prize will be forfeited and will be awarded to an alternate winner in accordance with the applicable Finalist Judging Criteria or Monthly Judging Criteria.

Only two alternate winners will be selected for the prize, after which the remaining prizes will not be awarded. If, by reason of a print or other error, more prizes are claimed than the number set forth in these Official Rules, the prize(s) will be awarded to the person with the highest scoring Submission in accordance with the above Judging Criteria from among all eligible entrants making purportedly valid claims to award the prizes available.

Verification of Potential Winner: THE POTENTIAL WINNER IS SUBJECT TO VERIFICATION BY SPONSOR OR ADMINISTRATOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE CONTEST. AN ENTRANT IS NOT A PRIZE WINNER UNLESS AND UNTIL ENTRANT’S ELIGIBILITY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE AND NO FURTHER ACTION IS NEEDED. ADDITIONALLY, IF THE SELECTED ENTRANT IS LOCATED IN CANADA, SUCH ENTRANT MUST FIRST CORRECTLY ANSWER WITHOUT ASSISTANCE, A MATHEMATICAL SKILL-TESTING QUESTION IN ORDER TO BE DECLARED THE PRIZE WINNER.

Disclaimer: Sponsor, Instagram, Inc., Big Monocle, and any of their respective parent companies, subsidiaries, affiliates, directors, officers, professional advisors, consultants, contractors, legal counsel, public relations firms, employees and advertising, fulfillment and marketing agencies (collectively, the “Released Parties”) will not be responsible for: (a) any late, lost, misrouted, garbled or distorted or damaged transmissions or entries; (b) phone, electronic, hardware, software, network, Internet, or other computer or communications-related malfunctions or failures beyond Sponsor or the Released Parties’ reasonable control; (c) any Contest disruptions, injuries, losses or damages caused by events beyond the reasonable control of Sponsor or the Released Parties by non-authorized human intervention; or (d) any printing or typographical errors in any materials associated with the Contest.

  2. Limitations of Liability; Releases: By entering the Contest, you (and, if you are a Minor, your parents or legal guardians) release Sponsor and all Released Parties from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or delivery, misdelivery, acceptance, possession, use of or inability to use any prize (including claims, costs, injuries, losses and damages related to rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.
    IF YOU ARE A MINOR, YOUR PARENTS OR LEGAL GUARDIANS FURTHER AGREE TO INDEMNIFY EACH OF THE RELEASED PARTIES FROM ANY CLAIMS, COSTS, INJURIES, LOSSES, OR DAMAGES DESCRIBED IN THE PRECEDING PARAGRAPH WHICH MAY BE SUFFERED BY YOU.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE SPONSOR OR THE RELEASED PARTIES BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF USE, LOSS OF PROFITS OR LOSS OF DATA, WHETHER IN AN ACTION IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, ARISING OUT OF OR IN ANY WAY CONNECTED TO YOUR PARTICIPATION IN THE CONTEST OR USE OR INABILITY TO USE ANY EQUIPMENT PROVIDED FOR USE IN THE CONTEST OR ANY PRIZE, EVEN IF A RELEASED PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE AGGREGATE LIABILITY OF THE RELEASED PARTIES (JOINTLY) ARISING OUT OF OR RELATING TO YOUR PARTICIPATION IN THE CONTEST OR USE OF OR INABILITY TO USE ANY EQUIPMENT PROVIDED FOR USE IN THE CONTEST OR ANY PRIZE EXCEED $10. THE LIMITATIONS SET FORTH IN THIS SECTION WILL NOT EXCLUDE OR LIMIT LIABILITY FOR PERSONAL INJURY OR PROPERTY DAMAGE CAUSED BY PRODUCTS RENTED FROM THE SPONSOR, OR FOR THE RELEASED PARTIES’ GROSS NEGLIGENCE, INTENTIONAL MISCONDUCT, OR FOR FRAUD.

  1. Indemnity. To the maximum extent permitted by law, you agree to defend, indemnify and hold harmless the released parties from and against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, costs and expenses (including reasonable attorney’s fees) arising out of or accruing from any submission or other material uploaded or otherwise provided by you that: (A) infringes any copyright, trademark, or other intellectual property right of any person; (B) defames any person; or (c) violates the MORAL RIGHTS, OR rights of publicity or privacy of any person.

  2. Use of Name, Likeness, etc.: To the fullest extent permitted by applicable law, agreeing to participate in the Contest constitutes permission to use your name, hometown, aural and visual likeness and prize information for advertising, marketing, and promotional purposes without further permission or compensation (including in a public-facing winner list). As a condition of being awarded any prize, except where prohibited by law, the winner may be required to execute a written consent to permit the use of their name, hometown, aural and visual likeness and prize information for advertising, marketing, and promotional purposes without further permission or compensation.
